Freedom of worship - its constitutional and statutory regulation and reflection in the caselaw of the Constitutional Cour

This thesis aims to analyze legislation of the Czech legal order concerning religious freedom. The work is divided in two parts. The first part of the thesis deals with the definition of religious freedom in the first place. Afterwards the thesis describes the Constitutional law relating to the religious freedom (especially the Article No. 15 and No. 16 of the Charter of the Fundamental Rights and Freedoms of the Czech Republic), international conventions relating to the theme (e.g. The Universal Declaration of Human Rights, The International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights etc.) and further statutory provisions and legislative rules guaranteeing religious freedom in the Czech Republic. Major part of the thesis relating to the statutory provisions and legislative rules deals with the act No. 3/2002 Coll., on Freedom of religion and the status of churches and religious societies, as amended. The act No. 3/2002 Coll. constitutes basis of regularization of the freedom of religion in the Czech Republic. Economics of Religion: Analysis of Contributions in the Roman Catholic Church in the Czech Republic

The bachelor thesis Economics of Religion: Analysis of Contributions in the Roman Catholic Church in the Czech Republic focuses on economics of religion in the enviroment of the Czech republic and especially the case of the Roman Catholic Church. The main aim of the thesis is to analyze the situation of the religious market and the role and position of the Roman Catholic Church within it, in regards to participation in religious institutions, voluntary donations etc. By studying the relationship between the state and church and it's determined financing system it is possible to set the model for the degree of financial participation of the church's members (voluntary contributions). By using a regression analysis, a hypothesis is tested on specific empirical data - the amount of voluntary contributions, (un)employment, age, size of the church, and percentage of women in the population.
The matter of the restitution of the church property after 1989

The theme of the thesis: ,,The matter of the restitution of the church property after 1989", has been chosen due to the interesting public debate about this topic, which is very interesting, topical, sharp and clearly very controversial. The importance of the issue adds its development, while there are still continually opened new aspects and perspectives of this topic. The topic is significant by ambivalence of opinions, basically a certain helplessness and by the sharp clashes of the different opinions of the professional community. The cause is very simple. It is a problem with very complex historical and legal background. The diploma thesis attempts to uncover the background of the preparation of the restitution process and of the separation of the church and state after the 1989 including their historical background and important constitutional aspects. My goal was to describe a path which led to the enactment of the law about the property settlement with the churches and religious societies in 2012. The intention of this paper is not to cover all aspects of this topic, after all that is impossible in frame of one diploma thesis, but it should provide the reader a formally complex material which clarifies the causes and consequences of the enactment of the Act no. 428/2012 coll., about the...
Church-state settlement: Financial aspects

Church-state settlement: Financial aspects Abstract New draft law on Church-state settlement is presented mainly as an additional burden on the state budget of the Czech Republic. My work evaluates the proposed settlement from the perspective of both actors, besides the state view also the view of the Church is considered. The theoretical part focuses on the status of the Church in the Czech Republic and the historical development of its financing, in its conclusion can be found a summary of the resolution of a property settlement in the Visegrad Group countries. The practical part is divided into two chapters: the first one compares the impacts of the different options of property settlement on the state budget, the second chapter focuses on the investment opportunities of the Church and religious communities. The main objective of the analytical part of my thesis is the evaluation of the return on investments on financial markets that would ensure a permanent source of financing for the Church and religious communities after 2043, which should be the year when all state financing of the Church ends. My analysis shows that the Church cannot get needed revenues in the long run of 60 years so it must find an additional source of income.

The diploma thesis provides a comprehensive historical analysis of the relation between the state and the Church and the legal norms that are relevant to this issue and tries to interpret individual key provisions. It reveals the intentions of the Republican legislators to cope with Maltese grievances and the Latifunds, the efforts to redistribute large territorial units to smaller farmers and thus to start economic production. The diploma thesis also focuses on the consequences of the first land reform, which in the end did not fully fulfill the original expectations. For this reason, the legislators proceeded to review it, which is also analyzed in the diploma thesis. It also addresses the controversial question of the nature of ecclesiastical property, which in the past was in another position than it would be after the process of straightening relations with churches and religious societies. The thesis seeks to answer the question whether the concept of restitution of ecclesiastical property respects the concept of land reform.

Resumé This thesis concerns itself with legal position and operation of The Federation of Jewish Communities in Czech Republic. It brings the perspective on fundamental legal regulations which form a base for operation of The Federation of Jewish Communities and which the Federation is obliged to conform to. The thesis also includes historical insight and cultural background of Jewish religion and its relevant particularities. The aim of my thesis was to put the operation and standing of The Federation of Jewish Communities into Czech legal framework, to describe a specific linkage of legal regulations with religious practice and Jewish religious observances and to use real-life examples to demonstrate the impact and reflection of legal regulations in life of members of Jewish communities and associated organizations. This thesis is divided into four chapters (apart from Preamble and Conclusion), most of which is then further divided into subchapters and other sections. The Economy of Churches and Religious Societies in the Context of so-called Church Restitution

This diploma thesis is focused on the issue of the economy of churches and religious societies in the context of so-called church restitution. The first section focuses on the position of churches and religious societies within civil society, the legislative framework of churches and religious societies, the church restitution and their current form, as well as the economy of churches and religious societies. The empirical section attempts to answer the outlined research questions. It explains the consequences of church restitution for the selected sample of churches in relation to the church economy, and it focuses on the church entrepreneurship in the context of church restitution.
